General Notice of New Operating Rule | |

At the Open Meeting on March 1st, 2022, the Board of Directors adopted a new Operating Rule that is now added to Rule 14 under the heading “General Rules” of the Rules and Regulations and reads as follows:
14. Please see the Architectural Standards and Procedures and Contractor Rules for alteration and remodeling requirements, policies, and practices. Note that work is allowed only Monday thru Friday, 8:00 a.m. to 4:30 p.m., except holidays. Any work that requires the Association’s approval also requires a signed Alteration Agreement. No improvement, change, alteration, or attachment may be approved, nor any work performed, unless the Owner is in Good Standing and remains in Good Standing throughout the entire duration. If the Owner is not in Good Standing at any time, the Association may suspend any approval and require that all work stop until the Owner is in Good Standing. “Good Standing” as used in this Rule shall have the same meaning as defined in the CC&Rs. The following is added to paragraph 25 of the “Architectural Procedures” section of the Alteration Agreement: 25. Owner’s Good Standing. The Owner shall be in Good Standing at the commencement of the Project and shall remain in Good Standing throughout the entire duration of the Project. If the Owner is not in Good Standing at any time during the Project, the Association may suspend any approval and require that the work stop until the Owner is in Good Standing. “Good Standing” as used in this paragraph shall have the same meaning as defined in the CC&Rs.
The following is added as paragraph 23 to the “Alteration Agreement Highlights” section of the Alteration Agreement: 23. The Owner must be in Good Standing, as defined in the CC&Rs, at the commencement of and throughout the entire duration of the Project.
The purpose of these changes is to require Owners to fulfill their monetary obligations to the Association and pay their fair share of Association expenses before spending money on remodels, alterations, and personal improvements. The effect will be to allow such work only when the Owner is in Good Standing, as defined by the CC&Rs. Under current section 1.20 of the CC&Rs, " ‘Good Standing’ shall mean those Members who are current in the payment of their Assessments, fees, and fines, and who are not in violation of the Governing Documents. Members who are more than thirty (30) days delinquent in the payment of their Assessments, fees, or fines, or have been found in violation of the Governing Documents, following written notice and an opportunity to be heard as provided for in the Bylaws, shall automatically cease to be in Good Standing until such time as their Assessments, fees and fines are paid and their violations of the Governing Documents have been cured.” Copies of both above mentioned documents are available upon request in the office or can be found on the CPE Website.
